By creating an account, downloading, or using the NightFind app, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services.

Nightlife venues, clubs, and bars featured in the app may have their own age restrictions, typically 18+ or 21+ depending on local laws. You are responsible for complying with all applicable age requirements when visiting venues.

3. Account Registration and Security

To access certain features, you must create an account. You agree to:

3.2 Account Termination

4. User Obligations and Conduct

When using NightFind, you agree to:

Prohibited Activities

• Attempt to hack, reverse engineer, or compromise app security
• Create fake accounts or impersonate others
• Post false reviews or misleading venue information
• Scrape, copy, or redistribute app content without permission
• Use automated tools (bots) to access the service
• Interfere with other users' access or enjoyment of the app
• Promote violence, illegal activities, or harmful behavior

5. Service Description

5.1 Core Features

NightFind provides:

• Discovery of nightlife venues (clubs, bars, lounges)
• Event listings and notifications
• Route planning and navigation features
• User reviews and ratings
• Personalized recommendations
• Social features for planning nights out

5.2 Premium Listings

NightFind offers premium listing opportunities for venues, clubs, and bars. Premium venues receive enhanced visibility, featured placement, and access to analytics. These are paid promotional placements clearly marked within the app.

Premium listings do not affect our commitment to providing accurate, unbiased information. User reviews and ratings for premium venues are not influenced by their premium status.

6. Intellectual Property Rights

6.1 Our Content

All content, features, and functionality of NightFind—including but not limited to text, graphics, logos, icons, images, audio clips, video, data compilations, and software—are owned by NightFind or our licensors and protected by international copyright, trademark, and other intellectual property laws.

6.2 User-Generated Content

By submitting reviews, photos, or other content to NightFind, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, display, and modify your content in connection with our services.

You retain ownership of your content but represent that you have the right to share it and that it doesn't violate any third-party rights.

7. Third-Party Services and Venues

NightFind provides information about third-party venues and may link to external websites or services. We are not responsible for:

• The accuracy of venue information (hours, pricing, events)
• The conduct, policies, or practices of venues
• Third-party website content or privacy practices
• Disputes between users and venues

Venue information is provided "as is" and may change without notice. Always verify critical details (hours, dress code, age requirements) directly with the venue.

8. Disclaimers and Limitation of Liability

8.1 Service "As Is"

NightFind is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that:

• The service will be uninterrupted, secure, or error-free
• Venue information will be accurate or up-to-date
• Defects will be corrected
• The app is free from viruses or harmful components

8.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NIGHTFIND AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Personal injury or property damage
• Incidents occurring at venues or events discovered through the app
• Actions or omissions of other users or third parties
• Reliance on venue information or reviews

Our total liability for any claims arising from your use of NightFind shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

8.3 Safety and Responsibility

You are solely responsible for your safety and well-being when using NightFind and visiting venues. We strongly encourage you to:

• Drink responsibly and never drink and drive
• Travel with friends and stay aware of your surroundings
• Use ride-sharing services or public transportation
• Report any safety concerns to venue staff or authorities
• Trust your instincts and leave situations that feel unsafe

9. Indemnification

You agree to indemnify, defend, and hold harmless NightFind and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

• Your use of the app
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your user-generated content

10. Payment and Subscriptions

10.1 Free and Premium Features

NightFind offers both free and premium features. Premium features may include:

• Ad-free experience
• Advanced route planning
• Exclusive venue access and deals
• Priority customer support

10.2 Billing

Subscriptions are billed through your App Store account (Apple App Store or Google Play Store). Payment will be charged upon purchase confirmation. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.

10.3 Cancellation and Refunds

You may cancel your subscription at any time through your App Store account settings. Refunds are subject to the policies of the respective app store (Apple or Google).

11. Privacy and Data Protection
